fitkin terms of use
Effective: August 2026, updated October 9, 2026. fitkin is operated by PathoBrainSeq Inc. (contact: pathobrainseq+fitkin@gmail.com).
By creating a kin card or using fitkin, you agree to these terms.
what fitkin is — and isn't
- fitkin helps you discover, message, review, and connect with people nearby who want a workout partner.
- We do not organize, supervise, chaperone, verify, background-check, insure, or control any user, meetup, workout, route, location, or activity.
you are responsible for your own safety
- You alone decide whether to message, meet, or train with anyone you find on fitkin, and you alone are responsible for that decision and for what happens afterwards.
- No screening. We do not verify users' identities, ages, backgrounds, criminal histories, health, fitness levels, intentions, or suitability as workout partners. A profile, photo, review, workout log, distance, "signed in" label, or any other badge means only what its label says. It is not identity verification, age verification, background screening, a health certification, a safety rating, or our endorsement.
- Assumption of risk. You understand that meeting strangers carries real risks, including injury, illness, assault, harassment, theft, property damage, emotional distress, and death. Exercise also carries an inherent risk of injury. You voluntarily choose whether, when, where, and how to interact with another user, and to the fullest extent permitted by law you assume all of these risks.
- Any meeting, workout, conversation, dispute, injury, loss, or other incident between users, online or offline, happens at your own risk. To the fullest extent permitted by law, PathoBrainSeq Inc. is not responsible for the conduct of any user.
- You are responsible for your own health, fitness level, and medical decisions. Ask a doctor before starting a new activity if you are unsure.
- Meet smart: first meetups in busy public places, tell a friend where you're going and with whom, use your own transport, and leave if something feels off.
- Emergencies. If you believe there is an immediate danger, contact local emergency services (911 in the US) first. Reports to fitkin are not a substitute for police, medical, or emergency help.
release, limitation of liability, and indemnity
- RELEASE. To the fullest extent permitted by law, you release PathoBrainSeq Inc. and its officers, employees, and agents from all claims, demands, and damages of every kind, known and unknown, arising out of or connected with your interactions with other users or any meeting, workout, or activity you arrange through fitkin.
- CALIFORNIA UNKNOWN-CLAIMS WAIVER. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." Residents of other places waive any similar law to the extent permitted.
- LIMITATION OF LIABILITY. To the fullest extent permitted by law, PathoBrainSeq Inc. is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, property damage, or loss caused by the conduct of any user, on or off fitkin. For claims that may lawfully be limited, our total liability for all claims relating to fitkin will not exceed US$100.
- INDEMNITY. If your content, your conduct, an unlawful act by you, or your breach of these terms causes a third party to bring a claim against PathoBrainSeq Inc., you agree to indemnify us for reasonable losses, costs, and expenses arising from that claim, to the extent permitted by law.
- What this does not cover. Nothing in these terms limits liability that cannot be limited by law, such as liability for our own fraud, gross negligence, or willful misconduct, or rights you have under consumer-protection laws that cannot be waived. If any part of these terms is found unenforceable, the rest still applies.
community rules
- fitkin is for finding workout partners — nothing else. No harassment, hate, threats, sexual
content, spam, impersonation, or illegal activity.
- Photos you upload (profile photo, workout moments) must be yours, safe-for-work, and
workout-related. No photos of other people without their consent.
- You must be at least 18 years old to use fitkin. By using fitkin you confirm that you are 18 or older. Accounts that appear to belong to someone under 18 are removed.
reports, blocks, and bans
- You can block any user (they can never message you again — enforced on our servers) and report
any user or photo from inside the app.
- We review reports with human review and may also use automated checks. We may remove content or permanently ban any
account that breaks these rules, at our sole discretion, without notice.
- Banned accounts lose the ability to publish a card, post photos, and send messages.
- We do not promise that we will detect every problem, prevent every harmful interaction, or resolve every dispute between users.
kin reviews
- You can rate kin you have actually connected with (3-5 stars, positive tags, short comment).
Reviews go live 14 days after you post.
- Be honest and kind. Reviews that harass, deceive, or are exchanged for anything of value
get removed and can get your account banned. Bad experiences belong in report or block, not reviews.
- You can edit or delete your own reviews anytime; deleting your account removes your reviews too.
your content
- You keep ownership of what you post. You give fitkin permission to store and display it to
other users as part of the service.
- We may remove any content that breaks these rules. Objectionable content reported to us is
actioned within 24 hours.
the service
- fitkin is provided "as is", free of charge, with no warranty of any kind. We may change or
discontinue features at any time.
- Your privacy: see the privacy policy. You can delete your account
in the app at any time.
